LuxSmart Realty is a real estate brokerage Company located in Tennessee, which provides real estate brokerage services in Tennessee and via other real estate agents and brokers as a franchise of LuxSmart Realty in the United States. These are terms that one needs to read thoroughly before using our services or our website.

Vigilance to the Homeowners, Buyers, and Sellers

Through the services of LuxSmart Realty, you realize that we are your real estate brokers and agents, and our services are a flat fee when it comes to home sales, purchases, and investments. The action of a third-party vendor, agent, or contractor lies beyond our control, but we can also refer you to such professionals or franchisees. The sellers and investors have a flat-fee model for all the services.

This contract concerns you (the “User” or “Client” herein referred to as the User) and LuxSmart Realty, LLC. (LuxSmart, “we” and “us” herein referred to as LuxSmart).

Your usage of the LuxSmart Realty site and services preconditions these terms and conditions. In case you disagree with the terms, then you should stop using the site and services.

Use of Services

You do not agree to use the services of LuxSmart Realty in an illegal or forbidden manner. You are only liable for any activities that take place under your name. Seller, Buyer and Investor Terms.

LuxSmart Realty supports the franchisee-based home buying, selling and investment services in Tennessee and throughout the country. We may refuse any request in case of inaccuracy or misleading information provided.

Flat-Fee Structure

LuxSmart Realty operates on a flat-fee model. Sellers will be charged a fixed fee for services provided, with no hidden commissions or percentage-based fees. However, buyers have to pay commission-based fees to the broker, which is negotiable.

Cash Back/Commission Reduction.

In selected states, LuxSmart Realty will provide either cash back or a setback in commission, according to the laws and conditions. Tennessee residents can be given a gift card instead of cash back, and in particular cases, there might be a reduction in commission. This will depend on the nature of the transaction.

Real Estate Transactions

LuxSmart Realty is just a match-making company between clients and real estate agents and brokers that facilitate the sale, purchase, or investment of property. Any dealings and legal relationships involving you and the agent or the broker do not occur with LuxSmart Realty, and it is your responsibility to comprehend and negotiate any contracts.

Arbitration and Dispute Resolution.

These terms and conditions, and any issue that transpires due to your use of the LuxSmart Realty site and its services, will be subject to the laws of the State of Tennessee, irrespective of its conflict-of-law principles. Any conflict that might emerge as a result of utilizing this site or these services will be eliminated through binding arbitration under the regulations of the American Arbitration Association.

Class Action Waiver

You acknowledge that any grievance or complaint that you have against LuxSmart Realty will be settled individually, and not in a class action. Arbitration claims should be filed according to the claims above.
